AutoStore Holdings Ltd. – AutoStore Intends to Appeal ITC Decision to U.S. Court of Appeals; UK trial to begin 15 March as AutoStore strengthens case on key patents

Nedre Vats, 10 March 2022. AutoStore Holdings Ltd. (“AutoStore” or the “Company”, OSE ticker code “AUTO”) today announced that it intends to appeal to the U.S. Court of Appeals for the Federal Circuit the decision of the International Trade Commission (“ITC”) in the case AutoStore brought against Ocado Group plc and certain of its affiliates (“Ocado”) concerning the Ocado Smart Platform (“OSP”). The Commission today affirmed the initial decision by Judge Charles Bullock on 13 December 2021, which found that despite Ocado’s infringement of the patents asserted by AutoStore, those patents were invalid.

AutoStore: Fourth quarter 2021 financial results

(Oslo, 17 February 2022): AutoStore Holdings Ltd. (AutoStore, OSE:AUTO) today announces revenues in the fourth quarter 2021 of USD 93.2 million, up 58.3% from the corresponding quarter in 2020 (USD 58.9 million), bringing the full-year revenues to USD 327.6 million, exceeding the 2021 guidance of revenues of over USD 300 million. The company had an order intake of USD 198.4 million, bringing the backlog to USD 456.5 million, and AutoStore raises the 2022 revenue guidance to USD 550-600 million.

All Ocado cases now stayed against AutoStore in Germany

(Nedre Vats, 3 February 2022) All Ocado’s claims against AutoStore in Germany have now been stayed pending a determination by the German Patent Office of AutoStore’s ongoing challenge to the validity of Ocado’s utility model IP rights in its claims.

Second German Court stays Ocado case against AutoStore because Ocado IP right may be invalid

(Nedre Vats, 31 January 2022) Following the Munich District Court’s order on Thursday last week staying Ocado’s infringement claims against AutoStore in that court, the Mannheim District Court has now also stayed a similar claim brought by Ocado for an order blocking the sale of AutoStore’s B1 robot in Germany.

(Nedre Vats, 24 January 2022) AutoStore Holdings Ltd. (AutoStore, OSE:AUTO) continues all the patent infringement lawsuits that the AutoStore Group filed in late 2020 against Ocado Group. These actions are in several venues, including the U.S. International Trade Commission and the U.K. High Court, and seek (among other remedies) injunctions barring the manufacture, sale, and use of Ocado’s infringing products in the U.S. and the U.K., as well as monetary damages. Ocado itself has initiated litigation against AutoStore in the U.S. and Germany, alongside oppositions in the European Patent Office.
